Terms of Service
1. The agreement
These terms are a contract between you and [OPERATOR LEGAL NAME], [legal form], [registered address], [country], [registration number] (“Fit Royale”, “we”, “us”). They cover the Fit Royale mobile app, the fit-royale.com website and everything we provide through them (the “Service”). By creating an account or using the Service you agree to them. Our Privacy Policy explains how we handle your data and is part of this agreement.
2. Who can use Fit Royale
You must be at least 18 years old and legally able to enter a contract. Fit Royale involves weight, body measurements and physical activity, so it is not built for children and we do not allow accounts for anyone under 18.
3. Your account
- You need an account to use the app. You can sign up with an email address and password, with Sign in with Apple, or with Google.
- Keep your sign-in details to yourself. You are responsible for what happens under your account until you tell us it has been compromised.
- Give us accurate information and keep it current. Usernames that impersonate someone else, or that are offensive, may be changed or removed.
- One person, one account. Duplicate accounts used to gain an advantage in a competition will be removed.
- You can delete your account at any time in Settings. Section 11 explains what happens then.
4. What Fit Royale is, and is not
Fit Royale lets you create a fitness competition, invite friends, and compete on weight loss, steps or active calories with a shared leaderboard, check-ins, streaks and badges.
There is no money in Fit Royale. The Service does not let players stake, pool, hold, transfer or win money or prizes of monetary value. If a group of friends decides to bet among themselves outside the app, that is entirely their own arrangement; Fit Royale is not a party to it, does not hold funds, does not enforce it and is not responsible for it.
Fit Royale is not a medical service and gives no medical advice. See section 9.
5. Competitions and fair play
- Creators set the rules. The person who creates a competition chooses its type, dates and settings, and can remove a participant or a submission that breaks its spirit. Creators are expected to act fairly and are responsible for the invitations they send.
- Verified check-ins. Weight battles rely on weigh-ins that may include a photo of the reading. Steps and calorie battles read from Apple Health or Health Connect. Submitting a false reading, editing a photo, using someone else's data, or manipulating a health app's data is cheating.
- Cheating has consequences. We may remove submissions, remove you from a competition, reset points or badges, or close your account. Competition members can see each other's submissions precisely so that the group can spot problems itself.
- Results are final when the competition ends. Standings are computed by our scoring rules, which we may adjust between competitions to keep things fair. We do not re-run finished competitions.
- Availability. A competition depends on the app, your devices, your health apps and the internet all working. If something breaks mid-battle, we will do our best to fix it, but we cannot guarantee a particular competition completes as planned.
6. Free and Pro
Fit Royale is free to download and play. The free plan lets you be in one active competition at a time (created or joined) with up to 5 people in it.
Fit Royale Pro is a paid subscription that removes the limit on active competitions, raises the size of competitions you create to up to 50 people, and unlocks Pro features such as Competition Evolution and Timelapse in the competitions you create.
Limits follow the creator of a competition. If a Pro subscriber creates a competition, everyone in it enjoys that competition's size and Pro features, whether or not they subscribe. A free player only meets a limit when creating a competition beyond the free size, or when trying to be in a second active competition at the same time.
We may change what is included in the free plan and in Pro. If we reduce what an active Pro subscription includes, we will tell you in advance and you may cancel before the change applies.
7. Subscriptions
- Billed by the store. Pro is sold through the Apple App Store or Google Play as a monthly or yearly subscription. Payment is taken by Apple or Google under their terms. We never see your card details.
- Prices. The price and currency are shown in the app before you buy. Prices may differ by country and include applicable VAT.
- Automatic renewal. Your subscription renews automatically at the end of each period, at the price shown when you subscribed, unless you cancel at least 24 hours before the end of the current period.
- Free trial. The yearly plan may include a 7-day free trial for new subscribers. If you do not cancel before the trial ends, the yearly price is charged. One trial per person.
- Cancelling. Cancel any time in your Apple ID subscription settings or in Google Play → Subscriptions. Deleting the app or your Fit Royale account does not cancel a subscription. After cancelling you keep Pro until the end of the period you paid for.
- Refunds. Refunds are handled by Apple or Google under their policies. If you are a consumer in the EU, you agree that Pro is provided immediately after purchase and that you lose the 14-day right of withdrawal once the digital service has begun, to the extent the law allows.
- Price changes. If we change the price of Pro, the store will tell you in advance and the change applies only from your next renewal, after you have had the chance to cancel.
8. Your content and conduct
You own what you put into Fit Royale: your photos, username, bio and messages. You give us permission to store, process and show that content to the members of your competitions, which is what the app needs to function, and to no one else except as the Privacy Policy describes.
Do not use Fit Royale to:
- harass, shame or bully anyone, including about their body or weight;
- post sexual, violent or otherwise abusive content, or someone else's photo without their consent;
- invite people who have not agreed to join, or spam invitation links;
- break the law, infringe anyone's rights, or interfere with the Service, its security or other players' devices;
- reverse engineer, scrape or resell the Service.
We may remove content and close accounts that break these rules.
9. Health and safety
Fit Royale is a game, not a health programme. Nothing in the app is medical advice. Before starting a weight-loss or exercise competition, especially if you are pregnant, have an eating disorder history, a heart condition, diabetes or any other medical condition, talk to a doctor.
Set realistic goals. Rapid weight loss, extreme calorie restriction and over-exercising are dangerous. Stop and seek help if you feel unwell. You are responsible for your own health decisions and for how you take part in a competition. The app's readings depend on your scale, your phone and your health apps, and may be inaccurate.
10. Our rights
The Fit Royale app, website, name, logo, design, badges and code are ours or our licensors' and are protected by intellectual property law. We give you a personal, non-transferable, revocable licence to use the app on your own devices for its intended purpose. That is the only right you get. Share cards generated by the app carry Fit Royale branding and may be shared freely.
11. Ending things
- You can stop using Fit Royale at any time and delete your account in Settings. Your data is deleted as described in the Privacy Policy. Any competition you created continues for its other members with your entries removed. A paid subscription must be cancelled separately with the store.
- We may suspend or close your account if you break these terms, cheat, or put other players or the Service at risk. Where reasonable, we will warn you first. If we close your account for a breach, you are not entitled to a refund of any subscription period.
- We may also discontinue the Service or parts of it. If we shut Fit Royale down, we will give at least 30 days' notice in the app and you will be able to export your data on request.
12. Warranties and liability
We work hard to keep Fit Royale running and fair, but we provide it “as is”. We do not promise it will be uninterrupted, error-free, or that it will help you lose weight or reach any fitness goal.
To the extent the law allows, we are not liable for indirect losses, for losses caused by your health apps, devices or internet connection, for the actions of other players, or for any arrangements players make among themselves outside the app. Our total liability to you for anything arising from the Service is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, for fraud, or your statutory rights as a consumer in your country of residence.
13. Law and disputes
These terms are governed by the laws of Romania. If you are a consumer living elsewhere in the EU, you also keep the protection of the mandatory consumer laws of your country, and you may bring a claim in your local courts.
If something goes wrong, email us first at hello@fit-royale.com; most problems are quicker to fix than to litigate. EU consumers can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, and in Romania the Autoritatea Națională pentru Protecția Consumatorilor (ANPC), anpc.ro.
14. Changes to these terms
We may update these terms as the Service changes. For material changes we will notify you in the app at least 30 days before they take effect. If you keep using Fit Royale after that date, the new terms apply. If you do not agree, stop using the Service and delete your account before then. Previous versions are available on request.
